For many couples, starting a family is not a straightforward journey. If you are struggling to conceive, you may be considering alternative pathways to becoming a parent. This might include surrogacy or adoption.
If you have made the decision to pursue this path, or simply wish to start considering surrogacy or adoption as options, it is important to receive legal advice to guide you along the journey.
If you are considering surrogacy, we encourage you to consider the legal framework governed by the Surrogacy Act 2010 (Qld), which includes the following requirements:
The intended parents and the birth mother must consent to the surrogacy agreement.
The intended parents and the birth mother must be over 25 at the time of entering the agreement.
The intended parents must be residents of Queensland.
The intended parents and the birth mother must receive independent legal advice and counselling about the implications of the agreement.
